Chapter 13 Bankruptcy Process
The process of filing for Chapter 13 bankruptcy has certain requirements and deadlines that must be met in order to be successful. For clients who have filed for Chapter 7 bankruptcy in the last eight years, or for clients who have been threatened with foreclosure or repossession, Chapter 13 is the only bankruptcy option available.
The client needs to provide proof of income from the last six months, tax returns from the last two years, a copy of a driver's license and a Social Security card. Clients must also go through a consumer debt counseling program within the first 180 days before a case is filed. Finally, attendance at a financial management course is also required.
Once all information is in place and the client has gone through counseling, all information is filed in and the bankruptcy document is created. The client will come back to our office for a review and signing. Once the paperwork is filed, the client will have to appear at a creditors meeting and confirmation hearing about a month later.
